SOME GLICKMAN, CARTER & BACHYNKSY LAW FIRM VERDICTS AND SETTLEMENTS Major Arbitration Award - This is one of the largest arbitration awards ever reported in federal or state courts throughout the United States. We recovered attorneys fees for three law firms that are based on a percentage of $1 billion in projected royalties and other payments from an allergy drug. The fee agreement provided that "the total fees to the Lawyers were capped at $500 million and the total fees derived from royalties were capped at $300 million." See Tanox, Inc. v. Akin Gump Strauss Hauer & Feld, et. al., 105 S.W.3d 244, 249 (Tex. App.--Houston [14th Dist.] 2003, pet. denied). The case was appealed by the defendant and the fee agreement and award to the attorneys were confirmed in their entirety. Largest known wrongful termination verdict - Jury verdict for CPA fired for refusing to participate in illegal activity; Jimmy W. Janacek v. Triton Energy Corporation, et al.; largest known wrongful discharge verdict for a single employee; second largest jury verdict in the United States in 1992; settled confidentially before judgment entered. Tortious Interference - Jury verdict for oil distributor against a major oil company on breach of contract and tortious interference claims; paid in full. At the time, this was the largest damage award of its kind in Arkansas. See Robertson Oil v. Phillips Petroleum, 14 F.3d 373 (8th Cir. 1993, en banc). The dispute involved the propriety of the CFO's compensation, the manner in which the CFO handled the restatement of the company's financials, and related SEC and DOJ investigations and private shareholder suits. The company claimed that our CFO client had breached fiduciary duties, had taken excessive compensation, had misappropriated company funds, and was therefore terminated. We obtained a major jury verdict before the matter was resolved. < We represented the Chief Financial Officer of a publicly-traded company to recover on a breach of contract claim involving a Change in Control agreement. We obtained a jury verdict for the full amount of the contract claim, plus attorneys' fees and costs. We obtained an appellate court award affirming the judgment and collected the full amount of the contract claim, plus attorneys' fees and costs. < We represented the Chief Financial Officer of an Austin-based telecommunications software firm. We obtained a major jury verdict on claims involving the breach of a $3 million stock option agreement and a separate employment agreement. The Trial Court entered judgment on the employment agreement, but not on the stock option agreement. The matter is currently on appeal. < Jury verdict for Vietnamese plaintiffs against national convenience store chain in race and national origin discrimination case; settled confidentially. < Jury verdict for employee terminated in retaliation for filing workers' compensation claim; confidential settlement.
